January 2025. As planning reforms continue, with an apparent drive to increase housing delivery, there remain some very unresolved and difficult areas. One of those is the disposal of affordable housing to Registered Providers. The main reason behind that is the financial uncertainty for those RPs themselves. Some are arguing for a return of s.106BA, a way of seeking to vary a s.106 on viability grounds to deliver other tenures than those contained in often outdated policy. That would be a very sensible way of unlocking this, avoiding the presence of empty and completed affordable dwellings with no RP able to acquire.
